By using eCardica ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
eCardica is an online platform that allows users to browse, customize, and send digital greeting cards. The Service includes AI-powered card image generation and message suggestions powered by third-party AI providers.
3. User Conduct
You agree not to use eCardica to:
- Send cards containing threatening, harassing, abusive, or illegal content.
- Send unsolicited bulk cards (spam).
- Use the AI card creator to generate content that is offensive, illegal, or violates the rights of others.
- Impersonate another person or misrepresent your identity.
- Attempt to access other users' data or interfere with the Service's operations.
- Use automated tools to scrape, crawl, or extract data from the Service without permission.
4. AI-Generated Content
Cards and messages generated using our AI tools are created by artificial intelligence. While we strive for quality and appropriateness:
- We do not guarantee the accuracy, quality, or suitability of AI-generated content.
- AI-generated images and text may not always match your expectations.
- You are responsible for reviewing content before sending it to a recipient.
- Content that violates OpenAI's usage policies may be rejected by the AI system.
5. Email Delivery
While we make every effort to deliver cards reliably via email, we cannot guarantee delivery to every email provider. Delivery depends on factors outside our control, including the recipient's spam filters, email provider policies, and network conditions. eCardica is not liable for undelivered or delayed cards.
6. Intellectual Property
The eCardica name, logo, website design, and pre-made card library are the property of eCardica. AI-generated card images created through the Service may be used by the sender for personal, non-commercial purposes (such as sending the card to the intended recipient and sharing the card view link).
You retain ownership of any custom messages you write. By sending a card, you grant eCardica a license to transmit and display your message as part of the card delivery.
7. Disclaimer of Warranties
eCardica is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the fullest extent permitted by law, eCardica and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to undelivered cards, AI content issues, or data loss.
9. Modifications
We reserve the right to modify these Terms at any time. Changes will be posted on this page. Your continued use of the Service after changes constitutes acceptance of the modified terms.
10. Governing Law
These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Broward County, Florida.
